beckel, eric bolling, dana perino and greg gutfeld. it's 5:00 in new york city. this is "the five." ♪ ♪ >> kimberly: another death rocks the n.f.l. a week after the belcher murder-suicide. cowboys' defensive lineman josh brent charge charged with intoxication manslaughter after his passenger and teammate jerry brown was killed in a car crash outside of dallas on saturday. police say brent was speeding when the vehicle hit a curb and flipped. he is out of jail now after posting $500,000 bail. >> do you have anything you want to say to jerry brown's family? >> jerry brown is my dear best friend. i'm just trying to deal with his death right now. >> kimberly: i can only imagine. the fact it comes days after kansas city chief jovan belcher killed his girlfriend and then himself. the new video shows cops confronting him before the shooting. belcher was reportedly out drinking that night and brent's arrest is the 15th player arrested for suspicion of dui. it's a problem. what should the n.f.l. do about it? that's the discussion over the weekend. people have strong opinions about this

that said the lines of communication remain open. is there anything to read between the lines there, dana? >> chris, it's very heartwarming. but the fact of the matter is eve fn the speaker and the president are cuddling in the lincoln bedroom that's not going to get us a deal unless their stars are able to hammer something out. there have been no indications that they have been able to do so. so while certainly you'd want these guys to be meeting preferably more than once every three weeks as has been the case, i wouldn't take this as a sign that suddenly everything has turned around. we're probably no different place than we were yesterday. >> if you listen to bob corker, republicans know they have to give on taxes. so i guess, jackie, the key question is, what are the real options here? i mean, i suppose the house could pass the senate bill that extends tax cuts for 98% of americans, leave everything else until january. and use the debt ceiling as leverage. they could try to get some kind of deal on entitlement reform. maybe raising the age for medicare from 65 to 67. what's looking li

be reached. jessica yellen joins us, dana bash and david gergen. what's the latest? >> reporter: they are a long way from a deal, but late today speaker boehner and president obama did speak to one another on the phone. now, this is an important development because it's the first time they've talked in a week about the fiscal cliff. i am told, though, that there was no real progress in negotiations. in this sense there was no breakthrough on that central point of tax rates. as you know, president obama insists there is no deal unless the gop agrees to raise rates on the top 2% of earners. the gop says that's a nonstarter and the two men have not moved from that basic position. now, all of this quomz comes at the same time treasury secretary geithner also said for the first time the administration would be willing to go over the fiscal cliff if the gop does not agree to raise those rates. this was treasury secretary geithner earlier today on cnbc. >> is the administration prepared to go over the fiscal cliff? >> oh, absolutely. there's no prospect to an agreement that doesn't inv

dana bash is turning to more details now on what's apparently going wrong. what's the latest? >> reporter: a very interesting moment when the former democratic house speaker nancy pelosi had blunt advice for the current republican house speaker in terms of learning how to get his caucus together to find a deal that can actually pass congress and that the president will sign and those blunt words were, quote, figure it out. sources of both parties say a tuesday evening phone call between the president and speaker boehner did not go well. >> well, the president and i had a deliberate call yesterday and we spoke honestly and openly about the differences that we face. >> cnn has learned at least part of the reason why. tuesday's gop counteroffer included a renewed explicit call for a, quote, permanent extension of bush era tack cuts for the top 2% of americans. according to a democratic source familiar with the language. the democratic source argued that proposing to permanently extend tax cuts for the wealthy that the president calls a nonstarter shows that republicans are eithe
